Purpose and Scope
These General Terms and Conditions of Sale govern all sales of products and services offered by Irocrete on the website irocrete.com. Placing an order on the site constitutes full and unconditional acceptance of these Terms. Irocrete reserves the right to modify these Terms at any time. The terms applicable to an order are those in effect on the date the order is placed.
Capacity to Contract
To order on irocrete.com, you must be 18 or older, or act on behalf of a business or organization you are authorized to bind. The site is not intended for minors.
Product and Service Characteristics
Irocrete designs and manufactures custom concrete urban furniture, including planters, benches, tables, and other outdoor furnishing elements. Each product is customizable through our online configuration tool (choice of dimensions, concrete colors, logos, and finishes). The images, 3D renderings, and visualizations displayed on the site, including in the product customization tool and the IroCreation project builder, are provided for illustrative purposes only. Decorative elements shown in renderings (plants, flowers, lighting effects, staging) are not included with the product. The delivered product may differ in appearance from the on-screen visualization due to variations in materials, colors, textures, and manufacturing processes inherent to concrete products.
Pricing
Product prices are listed in Canadian dollars (CAD), excluding applicable taxes (GST and QST in Quebec, provincial taxes based on the delivery province). Prices displayed on the site through the product configurator and online catalog are authoritative at the time of order. Prices are calculated based on the selected dimensions, materials, colors, and customization options. Delivery charges, calculated based on distance from our facility, are added to the product price and are displayed before order confirmation. Irocrete reserves the right to modify its prices at any time without prior notice. A minimum order amount of $15,000 CAD (before taxes) is required.
Price Reductions and Promotions
Irocrete may offer price reductions in the form of promotional codes or credits applicable to a future order. Active promotions are displayed on the site and are subject to specific conditions (validity period, minimum order amount, limited number of uses). A maximum of two reductions may be applied per order. Reductions are not combinable unless otherwise stated. Promotions may be modified or withdrawn at any time without prior notice.
Orders
All products are custom-made to the client's specifications. An order is considered firm and final upon confirmation and receipt of payment or deposit. Due to the custom nature of the products, no confirmed order may be cancelled. Irocrete reserves the right to refuse any order for legitimate reasons.
Cancellations, Returns and Refunds
Because our products are made to order, an order that has been paid (or whose deposit has been received) cannot be cancelled, and no return or refund is accepted, except for a product that is defective or damaged on delivery. Details are set out in our Refund and Return Policy (irocrete.com/refund-policy).
Payment Terms
Payment may be made by credit card (via Stripe), PayPal, or bank transfer. For orders with a delivery date within our production window (3 months), full payment is required at the time of order. For orders with delivery scheduled beyond this window, a 50% deposit is required at order, with the balance due before delivery. In the event of late payment of the balance, a 14-day grace period is granted, after which Irocrete reserves the right to suspend delivery.
Delivery
Delivery charges are calculated based on distance from our Mirabel (QC) facility. Delivery timelines vary depending on the destination and are provided as estimates at the time of order. They do not constitute a firm commitment. Irocrete shall not be held responsible for delays attributable to shipping carriers or circumstances beyond its control. On-site pickup is available at our address: 14355 rue Rolland-Desjardins, Mirabel, QC J7J 0K5.
Receipt, Transport and Warranty
Receipt and transport — The customer must inspect the goods upon delivery or pickup. Any visible damage must be reported to Irocrete in writing, with photographic documentation, within twenty-four (24) hours of receipt. After that period, the goods are deemed to have been received in good condition, and damage occurring thereafter during handling, storage or installation is borne by the customer. Where damage occurs during transport and is reported within that period, the claim is filed with the carrier, who bears the cost; Irocrete manufactures and delivers a replacement product at no additional charge to the customer. Quality warranty — This twenty-four (24) hour period applies to damage visible on receipt. It does not apply to the quality of the product itself: if a product deteriorates or breaks in normal use because of a defect in manufacturing or materials, Irocrete will replace or repair it, at its option, at no charge to the customer. The duration of this warranty is assessed, as the legal warranty provides, in light of the price paid, the terms of the contract and the conditions of use of the product. Exclusions — The quality warranty does not cover damage resulting from installation, anchoring, handling, de-icing, use inconsistent with the product's intended purpose, lack of maintenance, vandalism or accident, nor normal wear or the variations in shade, texture and efflorescence inherent to concrete. Maintenance of the product after delivery is entirely the customer's responsibility. Withdrawal — In accordance with the Quebec Consumer Protection Act, the right of withdrawal does not apply to products manufactured to order or customized to the customer's specifications: no return or refund is accepted outside the cases set out in this article. These provisions apply subject to the applicable legal warranty.
Intellectual Property
All content on the irocrete.com website (text, images, graphics, logos, 3D renderings, software, and databases) is the exclusive property of Gestion Iroc INC. or its licensors and is protected by Canadian and international copyright and intellectual property laws. Any reproduction, distribution, or creation of derivative works without prior written authorization is strictly prohibited.
Limitation of Liability
Irocrete shall not be held liable for any indirect, incidental, special, consequential, or punitive damages resulting from the use of or inability to use its products or services. Irocrete's total liability shall be limited to the amount actually paid by the client for the product in question.
Personal Data Protection
Irocrete is committed to protecting its clients' personal data. The terms governing the collection, use, and protection of data are detailed in our Privacy Policy, available on the site. Each client may, at any time, request access to, correction of or deletion of their personal information, from their account (“My personal information”) or at irocrete.com/privacy-request; we respond within 30 days. Clients may also unsubscribe from promotional email communications at any time via the unsubscribe link included in each email or by withdrawing their consent at irocrete.com/privacy-request.
Governing Law and Dispute Resolution
These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein. Any dispute arising from these Terms shall be submitted to the courts of the judicial district of Montreal, Quebec, subject to a consumer's right to bring proceedings in the court of their domicile, guaranteed by the Consumer Protection Act.
